Welcome to Poira Labs LLC. By accessing or using our educational applications and services, you agree to be bound by these Terms of Service. Please read them carefully.

1. Acceptance of Terms

By creating an account, accessing, or using any Poira Labs LLC application or service, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you must not use our services.

2. Description of Service

Poira Labs LLC provides educational technology solutions for Saudi Arabian driving theory exam preparation. Our services include:

• Practice questions and mock exams (Standard and Dallah formats)
• Study lessons with text content and AI-generated audio
• Traffic sign references and educational materials
• Real-time 1v1 duel matches with competitive rating system
• Direct messaging between users
• Daily missions, leaderboards, and progress tracking
• Subscription-based access to premium features (Plus and Pro tiers)

3. Account Registration and Security

To access certain features, you may need to create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password confidential and secure
• Notify us immediately of any unauthorized access to your account
• Be responsible for all activities that occur under your account
• Not share your account credentials with others

You must be at least 13 years old to create an account. If you are under 18, you confirm that you have parental or guardian consent to use our services.

4. Subscriptions and Payments

4.1 Subscription Plans

We offer various subscription plans with different features and pricing. By subscribing, you agree to pay the applicable fees.

4.2 Payment Processing

All payments are processed through the Apple App Store or Google Play Store. Subscription prices are displayed in SAR (Saudi Riyal). We do not have access to your full payment details.

4.3 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the then-current subscription rate.

4.4 Price Changes

We reserve the right to modify subscription prices. We will provide at least 30 days' notice of any price increases. Continued use of the service after the price change constitutes acceptance of the new pricing.

5. Cancellation and Refunds

You may cancel your subscription at any time through the Apple App Store or Google Play Store. Your cancellation will take effect at the end of the current paid term.

6. Acceptable Use Policy

You agree not to:

• Use the service for any illegal or unauthorized purpose
• Violate any laws, regulations, or third-party rights
• Attempt to gain unauthorized access to any part of the service
• Interfere with or disrupt the service or servers
• Upload or transmit viruses, malware, or harmful code
• Reverse engineer, decompile, or disassemble the application
• Copy, modify, or distribute our content without permission
• Use automated systems (bots, scrapers) to access the service
• Harass, abuse, or harm other users
• Share account credentials or sell access to your account

7. Duel System Rules

The Application includes a real-time 1v1 duel system with competitive matchmaking and ratings. By using this feature, you agree to:

• Fair Play: Not manipulate the matchmaking or rating system through collusion, multi-accounting, deliberate match-fixing, or intentional losing
• Single Account: Maintain only one account. Creating multiple accounts for competitive advantages is strictly prohibited
• Connection Responsibility: Maintain a stable connection during matches. Repeated intentional disconnections may result in penalties
• Rating Integrity: Not artificially inflate or deflate your competitive rating (Glicko-1 system)
• Daily Lives: Not attempt to circumvent the daily duel lives limit for free-tier users

Violation of these rules may result in temporary or permanent suspension from the duel system and/or termination of your account.

8. Chat and Messaging Rules

The Application provides direct messaging between users. By using this feature, you agree:

• Not to send spam, unsolicited messages, or commercial content
• Not to send content that is offensive, threatening, harassing, or sexually explicit
• Not to share personal contact information of third parties without their consent
• That we may flag, review, or remove messages that violate these rules
• That other users may block or report you for inappropriate messaging behavior

9. Intellectual Property Rights

All content, features, and functionality of our services, including but not limited to text, graphics, logos, images, software, and learning materials, are owned by Poira Labs LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use our services for personal, non-commercial purposes only.

8. User-Generated Content

If you submit or upload content to our services, you:

• Retain ownership of your content
• Grant us a worldwide, royalty-free license to use, display, and distribute your content within the service
• Represent that you have the rights to submit such content
• Agree that your content does not violate any laws or third-party rights

11. Educational Content Disclaimer

Our application provides educational content for Saudi Arabian driving theory exam preparation. While we strive for accuracy, this application is a study aid and does not guarantee passing any official examination. Traffic rules, penalties (including Saher camera violations), and regulations referenced are for educational purposes only. Always refer to official Saudi Arabian traffic authority sources for the most current information.

12. AI-Generated Content

Certain features use artificial intelligence (Google Gemini AI) to generate question explanations and content translations, and Google Cloud Text-to-Speech for lesson audio. While we strive for accuracy, AI-generated content may contain errors. AI-generated content is provided for educational assistance only and should not be relied upon as the sole source of information.

13. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

14. Disclaimers and Limitations of Liability

14.1 Service "As Is"

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

While we strive to provide accurate and high-quality educational content, we do not guarantee the accuracy, completeness, or reliability of any content. Educational outcomes may vary.

14.3 Limitation of Liability

To the maximum extent permitted by law, Poira Labs LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, profits, or business opportunities, arising from your use of our services.

15. Indemnification

16. Termination

We reserve the right to suspend or terminate your account and access to our services at any time, with or without notice, for any reason, including but not limited to:

• Fraudulent, abusive, or illegal activity
• Non-payment of fees
• Extended inactivity

Upon termination, your right to use the service will immediately cease. You may also terminate your account at any time through your account settings.

18. Governing Law and Dispute Resolution

These Terms of Service are governed by the laws of the Republic of Turkey. Any disputes arising from these terms or your use of the service will be resolved in the courts of Istanbul, Turkey.

19. Third-Party Services

Our services may contain links to third-party websites or integrate with third-party services (such as Apple and Google for payments, Firebase for authentication, Google Gemini AI for content, and Google Cloud TTS for audio). We are not responsible for the content, privacy policies, or practices of these third parties.

20. Force Majeure

We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, or technical failures.

21. Severability

If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

22. Entire Agreement

These Terms of Service, together with our Privacy Policy and other referenced policies, constitute the entire agreement between you and Poira Labs LLC regarding the use of our services.
